Employment Visa is a permit granted to foreign nationals seeking employment within the country. It's designed for highly skilled professionals and those working for specific organizations like NGOs or Indian companies. Types Of Employment Visa

E-1 General Employment:

Suitable for skilled professionals working for Indian companies or foreign employers with a presence in India. Requires a valid job offer and proof of qualification.

E-2 Intra-company Transfer:

Intended for employees of a foreign company who are transferred to their Indian branch or subsidiary. Requires a valid transfer letter and evidence of employment with the parent company.

E-3 NGO:

Specifically for foreign nationals working for non-governmental organizations (NGOs) registered in India. Requires a letter of appointment from the NGO and proof of the organization's registration.

E-4 Projects in Power & Steel sectors:

Targeted for foreign professionals working on specific projects in the power and steel sectors. Requires a project approval letter and proof of employment related to the project.

Requirements:
  1. (i) The applicant is a highly skilled and/or qualified professional, who is being engaged or appointed by a company/ organization/ industry/ undertaking in India on contract or employment basis.
  2. (ii) Employment Visa shall not be granted for jobs for which qualified Indians are available. Employment Visa shall also not be granted for routine, ordinary or secretarial/clerical jobs.
  3. (iii) Employment Visa shall not be granted to promoter/ owner of a company holding majority stakes/ shares/ holding requiring to come on Business Visa instead of Employment Visa.
  4. (iv) The foreign national should seek to visit India for employment in a company/ firm/organization registered in India or for employment in a foreign company/ firm/organization engaged for execution of some project in India.
  5. (v) The foreign national being sponsored for an employment visa [E-1 & E-2 visas] in any sector should draw a gross salary in excess of Rs. 16.25 lakhs per annum.
  6. (vi) Foreigners eligible for honorary work with the NGOs [E-3 visas] may be paid an honorarium up to a ceiling of Rs. 10,000 per month.
  7. (vii) Persons of Indian origin and spouse/ children of an Indian citizen/ Person of Indian Origin/ OCI cardholder (other than those who are registered as OCI cardholder) must draw a minimum salary of Rs.3.60 lakhs per annum for being eligible for taking up employment.
  8. (viii) The Employment [E-1 & E-2] visa of a foreign national may be extended by the FRRO concerned beyond the initial visa validity period, up to a total period of 10 years from the date of issue of the initial Employment Visa, on an year to year basis subject to good conduct, production of necessary documents in support of continued employment, filing of Income Tax returns and no adverse security inputs about the foreigner. The period of extension shall not exceed ten years from the date of issue of the initial Employment visa.
FRRO Registration

1. Registration

In the case of Employment Visa issued for a period of 180 days or less, registration is not required with FRRO/FRO. The Missions/Posts may issue multiple entry Employment Visa for a period of 180 days or less. (v) If , however, the Employment visa is valid for a period of more than 180 days, it should carry an endorsement to the effect that the Employment Visa holder must register with the FRRO/FRO concerned within 14 days of arrival.

Spouse and Children (Dependents)
Visa to family members of a foreigner granted Employment Visa Family members / dependents of a foreigner who is granted `E’ visa[E-1 or E-2 or E-3] shall be granted E-1X/ E-2X/ E-3X visa (depending on the type of Employment Visa granted) subject to usual security checks provided the family members are otherwise eligible for grant of such a Visa. Its validity shall be co-terminus with the validity of the visa of the principal visa holder [or for such shorter period as may be considered necessary by the Indian Mission]. Such family members may also obtain Student Visa etc.of appropriate sub-category subject to usual security checks provided they are otherwise eligible for grant of such a visa. E-1X/E-2X/E-3X visa of the family members/ dependents of such foreign national can also be extended by the FRRO concerned beyond the initial visa validity period up to a total period of 10 years from the date of issue of the initial visa, co-terminus with the visa of the principal Visa holder, subject to no adverse inputs against the said foreign national.

Employment Visa cannot be converted to any other kind of visa during the stay of the foreigner in India except in the following circumstances by the FRRO/ FRO concerned:-

(a) Employment visa of a foreign national married to an Indian citizen/ Person of Indian Origin/ OCI cardholder who does not intend to continue on Employment visa may be converted to ‘X-1’ visa by the FRRO concerned.

(b) Conversion of ‘E-2X’ visas to ‘E’ visas of the spouse of an employee on intra-company transfer. The conversion of ‘E-2X’ visa of the spouse of an employee on intra-company transfer into Employment Visa may be permitted within the country
