Child Born In India
For Both Parents as Foreign Nationals: Notify the local FRO (Foreigners Registration Office) and FRRO (Foreigners Regional Registration Office) within 14 days of the child’s birth. This notification should be sent via email to the official email address of the concerned office. After receiving a travel document for the child from the relevant embassy or mission, the foreign national must apply for the necessary visa service for the child within 90 days of birth. If delayed beyond 90 days, this will be considered an overstay and may incur an overstay penalty. For One Parent as an Indian National and the Other as a Foreign National (when the parents wish for the child to acquire foreign nationality): Once the travel document (passport or any other travel document) for the child is issued by the relevant embassy or mission, the parents must apply for the appropriate visa service within 14 days from the date of issuance of the new travel document. Note: Foreign nationals are not permitted to commission surrogacy in India.

Surrender of Indian Passport/Acquiring other nationality

India does not recognize dual nationality. An Indian national who acquires foreign citizenship ceases to be an Indian national on the date the new nationality is granted. Holding or using an Indian passport after acquiring foreign citizenship (beyond a 3-month grace period) constitutes an offense under the Indian Passport Act, 1967, and may result in penalties.

Case 1:
  • Indian National in India Acquires Foreign Citizenship
  • Obtain a passport for the new nationality.
  • Surrender all Indian identity documents, including the Indian passport, Voter ID, Ration card, and any other nationality-related documents.
  • Apply for relevant visa services through www.indianfrro.gov.in within 14 days of acquiring foreign citizenship.
Case 2:
  • Indian National Abroad Acquires Foreign Citizenship and Enters India on an Indian Passport
  • Surrender all Indian identity documents, including the Indian passport, Voter ID, Ration card, and any other nationality-related documents.
  • Apply for necessary visa services on www.indianfrro.gov.in
